Avante Towne Houses consists of 52 privately owned homes governed by the the Texas Condominium Act found in chapters 81 and 82 of the Texas Property Code and a set of By-Laws carefully constructed to clarify that each homeowner owns and pays property tax for the land in front of, in back of and the side of some units as well as all paved areas, carports, garages and flower beds. They also own a portion of five parcels of common land that create greenbelts between some of the units.
 
Every homeowner is a member of the Council of Co-owners. Each year, 3 people volunteer to be elected to the governing board of this non-profit organization. Monthly dues are kept to a minimum and are based on the percentage of ownership each homeowner has purchased.
 
Avante Towne Houses Council of Co-Owners have agreed to be responsible for lawn maintenance and painting but all other maintenance inside and outside of each unit is the responsibility of the individual homeowner. Each homeowner is responsible to purchase their own property insurance but the Council of Co-Owners carries a policy that covers the greenbelts which are considered to be common land.

There is a lot of debate between "townhouse" and "condominium" because our builders called this a townhouse condominium project. The important issue is that we each own a single family dwelling that we are 100% responsible for. Our homes are referred to as "freehold estates" in our founding documents which includes the real property under, in front of, behind and beside certain units. Since our little community was built the definition of terms has changed and the Texas Uniform Condominium Act was passed in 1994 which made things even more complicated. Our founding documents call us townhomes and condominiums. This lack of consistent terminology makes purchasing a home in our small community very confusing for some title companies and lenders but not all. If you inform them about this at the beginning of your purchase it will make their job much easier and the closing much smoother. A survey is only correct if it includes the land which is clearly shown on all deeds signed by the original builders.
